Course Description

Learn what to expect during an audit from the initial letter requesting books and records to the final stage of the appeals process. In this course we’ll discuss the audit process in general, alternative audit procedures, mark-ups, bank deposits, sampling methods, record-keeping requirements, application of penalties, audit working-papers, computerized audits, and appeals procedures. This webinar is idea for Tax Directors and Managers, Controllers, and outside accountants.

Learning Objectives

  • Understand the requirements for maintaining records that are considered “adequate for sales and use tax purposes”, responding to demands to furnish those records when requested by Board of Equalization staff, and the potential consequences for failure to properly maintain or furnish records

  • Understand who bears the burden of proof and the presumptions that auditors may rely upon

  • Learn the normal procedures that auditors may use to complete the audit process and under what circumstances they may deviate from those procedures and use “alternative” methods

  • Understand your rights as a taxpayer during the audit and appeals process, what actions Board auditors can and cannot take during the audit process, and the role of the Taxpayer’s Rights Advocate (TRA)

  • Understand the basics of how the appeals process works including: how to prepare for an appeals hearing, the 30-day requirement to petition a Notice of Determination (Billing), settlement and offer-in-compromise (OIC) procedures, the hearing with the Members of the Board of Equalization
